Terms of Service

These terms govern your access to and use of Entertains Us, an entertainment discovery, booking, and management service operated by testXperience LLC.

Effective and last updated: October 11, 2026

1. Agreement to these terms

By accessing or using Entertains Us, you agree to these Terms of Service and our Privacy Policy. If you use the service for a business, venue, entertainer, band, organization, or another person, you represent that you have authority to bind them. If you do not agree, do not use the service.

2. Eligibility

You must be at least 13 years old to use the service. If you are under the age of legal majority where you live, a parent or legal guardian must authorize your use. You may use the service only where permitted by applicable law.

3. Accounts and authentication

  • Provide accurate information and keep it reasonably current.
  • Protect access to your email, Google or other identity-provider account, authenticator, and devices.
  • Do not share an account in a way that defeats security, authorization, or audit controls.
  • Notify us promptly if you suspect unauthorized access.
  • You are responsible for activity performed through your account unless applicable law provides otherwise.

Signing in authenticates an identity; it does not automatically grant entertainer, venue, tenant, or administrative permissions. We may require email verification, recent authentication, multifactor authentication, or other safeguards for particular features.

4. The service

Entertains Us may help users discover entertainment, view or manage events and profiles, communicate, submit inquiries or booking requests, coordinate availability, and use related management tools. Features may change, be introduced gradually, or be unavailable in some environments. Staging and preview features may use synthetic or test data and are not commitments or confirmed bookings.

5. Event listings and third-party information

Listings may be supplied by entertainers, venues, organizers, users, public sources, or third-party data providers. We may normalize, merge, update, or remove listings, but we do not guarantee that an event, time, location, admission price, age policy, availability, accessibility detail, or other listing information is complete, current, or error-free. Verify important details with the venue, entertainer, organizer, or ticket provider before relying on them or traveling.

A listing does not imply our endorsement of an event, venue, entertainer, organizer, product, or service.

6. Inquiries, bookings, payments, and third parties

Unless the service expressly states otherwise, an inquiry, request, proposal, tentative hold, calendar entry, or automated message is not a confirmed booking. A booking becomes binding only when the applicable participants complete the confirmation process and agree to any additional terms. Entertainers, venues, organizers, and requesters are responsible for their own representations, licenses, insurance, safety, accessibility, taxes, performance obligations, cancellations, refunds, and compliance with law.

If payment functionality is offered, the displayed transaction terms, fees, cancellation rules, and payment-provider terms will also apply. We do not presently promise that every transaction or dispute will be processed through the platform. We are not a party to agreements directly between users unless we expressly say otherwise.

7. User content and public profiles

You retain ownership of content you submit. You grant testXperience LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, display, distribute, and use that content as reasonably necessary to operate, secure, improve, and promote the service and the public listing or profile you requested. This license ends when the content is deleted from active systems, except for lawful retention, backups, prior authorized uses, and content others independently provided.

You represent that you have the rights and permissions needed to submit the content and that it is accurate enough for its intended use. Do not submit confidential information to a public field.

8. Acceptable use

You may not:

  • Break the law, infringe rights, impersonate others, or submit fraudulent, deceptive, defamatory, abusive, discriminatory, or unsafe content.
  • Harass people, send spam, scrape or harvest personal information, or use the service for unauthorized surveillance or advertising.
  • Upload malware; probe, bypass, disable, or interfere with authentication, authorization, rate limits, security, or service operation.
  • Access another user’s, organization’s, or tenant’s information without permission.
  • Use automated means that impose an unreasonable load or copy substantial parts of the service except as authorized in writing or by a published interface.
  • Reverse engineer or attempt to extract source code except to the extent a restriction is prohibited by law.

9. Our intellectual property

The service, software, design, branding, and content we provide are owned by testXperience LLC or our licensors and are protected by intellectual-property and other laws. These terms give you a limited, revocable, non-exclusive, non-transferable right to use the service for its intended purpose. They do not transfer ownership. Feedback you provide may be used without restriction or compensation, but we are not required to use it.

10. Third-party services and links

The service may rely on or link to identity providers, maps, ticketing, payment, messaging, venue, entertainer, or other third-party services. Their terms and privacy practices apply to their services. We are not responsible for third-party content, availability, security, or conduct.

11. Suspension and termination

You may stop using the service at any time and may request account deletion as described in the Privacy Policy. We may restrict, suspend, or terminate access when reasonably necessary to protect users or the service, investigate suspected violations, comply with law, address nonpayment where applicable, or enforce these terms. Where practical and lawful, we will provide notice and an opportunity to address the issue.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY LISTING, MATCH, COMMUNICATION, BOOKING, PARTICIPANT, OR THIRD-PARTY SERVICE WILL BE ACCURATE, AVAILABLE, SAFE, SECURE, UNINTERRUPTED, OR ERROR-FREE.

Nothing in these terms excludes warranties or rights that cannot lawfully be excluded.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESTXPERIENCE LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE.

OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

14. Indemnity for business and provider accounts

If you use the service on behalf of a business, venue, entertainer, organizer, or other organization, to the extent permitted by law you will defend and indemnify testXperience LLC from third-party claims arising from your content, your events or services, your agreements with other users, or your violation of these terms or law. This section does not apply to individual consumers where prohibited by law.

15. Governing law and disputes

California law governs these terms, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in Orange County, California, and the parties consent to their jurisdiction, unless applicable consumer law requires another forum. These terms do not require arbitration and do not waive a right to a jury trial.

16. Changes and general terms

We may update these terms as the service or law changes. We will post revised terms with a new date and provide additional notice when required. Material changes apply prospectively unless law permits otherwise. If a provision is unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of the service.
